Surah
MAAA-‘IDAH (The

‘A-‘uu-zu
Billaahi minash-Shay-taanir- Rajiim.

95. يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ لَا تَقْتُلُوا۟ ٱلصَّيْدَ
وَأَنتُمْ حُرُمٌ ۚ وَمَن قَتَلَهُۥ مِنكُم مُّتَعَمِّدًا فَجَزَآءٌ مِّثْلُ مَا
قَتَلَ مِنَ ٱلنَّعَمِ يَحْكُمُ بِهِۦ ذَوَا عَدْلٍ مِّنكُمْ هَدْيًۢا بَٰلِغَ
ٱلْكَعْبَةِ أَوْ كَفَّٰرَةٌ طَعَامُ مَسَٰكِينَ أَوْ عَدْلُ ذَٰلِكَ صِيَامًا
لِّيَذُوقَ وَبَالَ أَمْرِهِۦ ۗ عَفَا ٱللَّهُ عَمَّا سَلَفَ ۚ وَمَنْ عَادَ
فَيَنتَقِمُ ٱللَّهُ مِنْهُ ۗ وَٱللَّهُ عَزِيزٌ ذُو ٱنتِقَامٍ
95a. O ye who believe! Kill no wild game while ye are in
pilgrim-garb (Ehraam). And whoso of you killeth it of
set purpose he shall pay its forfeit in the equivalent of that which he hath
killed, of domestic animals, the judge to be two men among you known for
justice

95a. Yaaa-‘ayyu-hallaziina ‘aamanuu laa
taq-tulus-say-da wa ‘antum hurum. Wa man-
qatalahuu minkum-muta-‘ammidan- fajazaaa-‘ummislu maa
qatala minan-na-‘ami yah-kumu bihii zawaa
‘adlim-minkum

Commentary
It was described in the first
verse of this Chapter that entire beast of cattle (whether those are pet or
wild) are made lawful for the Muslims for food, because it was mentioned in Surah ‘An’Nisaaa’ that many lawful and pure
things had been made unlawful for the Jews due to their tyrannies and violence.
Therefore it has been told in the beginning of this Surah that Allah Almighty
has made lawful all the pure and clean animals for food. But there are some
restrictions on going to hunt the wild game during some specified days, so that
the obedient may be tried. Those restrictions are:
1. Kill no wild game while you are in pilgrim-garb until you do not
untie your Ihraam.
2. Gaming is unlawful in the premises of Ka’-bah (The
House of Allah Almighty).
Allah Almighty warns the Muslims that they should neither kill any
wild game while they are in Ihraam, nor
say anyone for hunting, and nor tell the address of any game to any hunter. And
if anyone of them kills it purposely in the form of pilgrim-garb, he should
have to pay its forfeit, from domestic animals in the equivalent of that which
he has killed. It will be judged in this manner that two men (dwellers of that
place or from the surrounding area) will be appointed for proving the price of
the killed animal with justice.
If the game is caught living
then it is incumbent to leave it immediately, and if killed, then there are two
ways:

If the game is killed
intentionally, then the killer will suffer two punishments i.e. (a) he shall
pay its fine in the equivalent of that which he has killed. (b) Allah Almighty
will take retribution from him i.e. He will punish him on the Day of Resurrection.

And if he killed the
game unintentionally, then he would have to pay only its penalty here but he
would not be punished on the Doomsday.
